Commute Life Pension or PTD

Lifetime benefits (life pension under LC 4659(a), or permanent total disability at the TD rate under LC 4659(b)) commuted with Tables 2 (male) and 3 (female): all remaining benefit, whether already commenced (Example D) or deferred until PD ends (Example E), or a partial commutation by uniform reduction of the weekly rate (Example F). Exact age and deferral are interpolated as the instructions direct.

Tables 2 and 3 are the DWC's 3% lifetime annuity tables based on the U.S. Decennial Life Tables 1989–91 (ages 15–95, deferral 0–14 years). For injuries on or after 1/1/2003, life pension and PTD rise each January 1 with the SAWW (LC 4659(c)); DEU's commutation request form uses the judge's annual SAWW assumption, or 3% if none is given, with the first increase on the January 1 after the benefit starts (Baker v. WCAB (2011) 52 Cal.4th 434). This page does the same (default 3%); set it to 0 for the flat-table value. COLA is ignored for injuries before 2003. The COLA weighting re-uses the official table's own survival and 3% discount year by year — an estimate that may differ slightly from DEU's worksheet.
